FMLA

The Family Medical Leave Act of 1993 (FMLA) is a federal regulation that allows qualified employees time off for certain family and medical reasons. To request an FMLA leave of absence please contact OneDigital. Stampin’ Up! will grant family and medical leaves of absence in accordance with FMLA guidelines and you are encouraged to contact OneDigital as soon as possible when anticipating an FMLA leave of absence.

Employees are eligible if they have worked for Stampin’ Up! for at least one year and have worked at least 1,250 hours over the previous 12 months.

Stampin’ Up! provides up to 12 workweeks of unpaid, job-protected leave to eligible employees for the following reasons:

  • Incapacity due to pregnancy, prenatal medical care, or childbirth
  • To care for the employee’s child after birth, or placement for adoption or foster care
  • To care for the employee’s spouse, child, or parent, who has a serious health condition
  • For a serious health condition that makes the employee unable to work.
  • For any qualifying exigency when a spouse, child, or parent is a military member on covered active duty or call to covered active-duty status.

FMLA also includes a special leave entitlement that permits eligible employees to take up to 26 weeks of leave to care for a covered service member during a single 12-month period. A covered service member is a current member of the Armed Forces, including a member of the National Guard or Reserves, who has a serious injury or illness incurred in the line of duty while on active duty.

During FMLA leave, Stampin’ Up! maintains the employee’s health coverage under all group health plans on the same terms as if the employee had continued to work. Employees are responsible for ensuring their portion of insurance premiums are paid during FMLA leave.

Bereavement Leave

An employee may receive up to eight days of bereavement leave for a spouse, partner, or dependent child and up to five days for other immediate family members. The amount of time approved is based on the relationship with the deceased, travel needs, funeral service responsibilities, etc., per the manager’s discretion.

You should notify your supervisor of your situation as soon as possible and fill out a Request for Time Off form. Your supervisor, in consultation with you, human resources, and their supervisor will determine the number of approved bereavement-leave days. Your supervisor should notify the payroll department of the granted leave and length of the absence.

Immediate family, for the purpose of bereavement leave pay, is defined as:

  • Spouse, partner
  • Child, stepchild, foster child (including in-laws)
  • Parents, step-parents (including in-laws)
  • Siblings, step-siblings (including in-laws)
  • Grandparents, step-grandparents (including great grandparents and in-laws)
  • Grandchildren, step-grandchildren (including great grandchildren)

Parental Leave

Eligible employees are entitled to paid parental leave following the birth, adoption, or foster care placement of a child. To be eligible, an employee must work part-time or full-time hours and have worked at Stampin’ Up! for a minimum of six months when the parental leave period begins. The amount of paid parental leave available for eligible employees will be determined based on caregiver status.

Primary caregivers will be eligible for up to six weeks of leave with pay equivalent to time scheduled to work, up to 40 hours in one week.

Secondary caregivers will be eligible for up to two weeks of leave with pay equivalent to time scheduled to work, up to 40 hours in one week.

Parental leave may be used in separate one-week periods but must be used within three months of the birth, adoption, or placement of the child.

Employees can request leave from their supervisor using the Request for Parental Leave form.

Jury and Witness Duty Leave

When called for jury duty, let your supervisor know as soon as possible. You will need to fill out a Request for Time Off form for the days you will miss. Stampin’ Up! will pay you equivalent to the pay for hours scheduled to work during the jury or witness leave period; however, you will have to submit any pay received by the court to Stampin’ Up!

Military Leave

Employees who are members of, or are joining the Armed Forces of the United States, shall be granted leaves of absence for military duty in accordance with all applicable laws and regulations. Employees may use, but are not required to use, accrued PTO while performing military duty.

Employees must provide verbal or written notice of military leave with as much advance notice as possible and may be asked to furnish written evidence of military assignment prior to leave. Employees must also furnish evidence of military service or training completion before returning to work.

Personal Leave of Absence

You must request a personal leave of absence by contacting OneDigital. You must use all accrued PTO before a personal leave of absence will be considered. Except in the case of a medical personal leave, you must also use any earned and unused floating holidays. Personal leaves of absence will only be granted where there is a compelling personal need and will not adversely impact the business. Personal leaves must be for a minimum of five working days. Time off without pay may only be granted with manager’s approval. A request for time off without pay, due to illness, must be accompanied by appropriate medical documentation.
